Preliminary Analysis Report of the Joint Parliamentary Committee (JPC) on the PDP Bill, 2019

The Joint Parliamentary Committee (JPC) has submitted its report on the Personal Data Protection Bill, 2019, to both houses of Parliament after a thorough analysis, following its introduction in December 2019. The committee’s commendable efforts involved comprehensive consultations with diverse stakeholders, resulting in a total of Ninety-Three recommendations in their published report, highlighting the meticulous scrutiny of the legislation.

The tabling of the JPC’s report marks a crucial step towards implementing privacy in India and enacting a robust data protection law. However, as we progress in this direction, there remains a need for further deliberation to ensure the creation of a comprehensive and effective data protection framework. This analysis document explores the key legal and policy provisions outlined in the report, comparing them to the previous Bill and emphasizing the importance of these changes. It also proposes practical recommendations to facilitate the establishment of a progressive and rights-based data protection regime in India.
